Dealing with the loss of a loved one is a deeply emotional experience, compounded by the complexities of estate administration.
If you have been appointed as the executor of an Estate, it is important to seek assistance as soon as possible to ensure you efficiently and effectively address the often sudden and significant legal and financial responsibility you now have.
Whether you are an Executor (named in a will) or an Administrator (appointed by the Probate Court), you are considered a Personal Representative who is responsible for managing and administering an Estate. This role comes with a legal obligation to act in the best interests of the Estate and to ensure that your loved ones wishes are carried out in accordance with their Will and the legal requirements of the Probate Act. It is crucial to follow the correct procedures when acting in this capacity as mistakes may result in personal liability.
Some of the routine responsibilities of an Executor may include:

Advising designated beneficiaries of your appointment as Executor;

Notifying the deceased's financial institutions, pension providers, insurance companies and Canada Revenue Agency of the death;

Cancelling the deceased's service providers, passport, and driver's license.

Probating the Will;

Advertising for and/or notifying creditors;

Notifying claimants and/or beneficiaries;

Locating and collecting the assets;
-
Collecting receivables and paying liabilities;

Filing final tax returns;

Accounting for assets and liabilities;

Liquidating and/or distributing the assets; and
-
Accounting for the administration of the Estate.
